Welcome to SpellingJoy.com ("Site", "we", "us", or "our"). Please read these Terms and Conditions ("Terms") carefully before using our services. By accessing or using the Site, you agree to be bound by these Terms.

1. Use of the Site

1.1 Eligibility

Our services are intended for use by parents or legal guardians ("Parents") who wish to assist their children ("Children") in practicing spelling. You must be at least 18 years old to create an account.

1.2 Accounts

Parents may create an account to:

• Add or remove Child profiles (only name and class information is collected).
• Generate practice links for Children.
• View performance statistics and progress.
• Access word lists, including publicly displayed lists.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2. Children's Use of the Site

Children do not require an account. They will access practice links generated by Parents. The Site does not collect personal information from Children beyond their name and class, as entered by Parents.

3. Free Trial and Subscriptions

3.1 Free Trial

We may offer a free trial for a limited period. After the trial, continued access requires a paid subscription.

3.2 Paid Subscriptions

Subscription plans may vary in price and duration. By subscribing, you agree to pay the applicable fees. Subscriptions will not renew automatically unless specified. Payment details are securely processed through our third-party provider.

No refunds are provided for partial use or early cancellation, unless required by law.

4. Fair Use of the PRO Subscription

4.1 Intended Use

The PRO subscription is designed for private family use only, enabling children in the same household to practise spelling and complete personalised practice games.

4.2 Permitted Usage Limits

• Up to 5 active child profiles per PRO subscription.
• Up to 1,000 tests/lists in total during each billing period (monthly or yearly, depending on the plan).

4.3 Excessive or Institutional Use

Any activity exceeding the limits above—including running SpellingJoy on an ongoing basis for a classroom, study group, or other educational institution—will be considered institutional use and requires the purchase of an appropriate school licence.

4.4 Monitoring & Enforcement

SpellingJoy reserves the right to review usage statistics and, in the event of excessive or institutional use, may take one or more of the following actions:

• Email warning requesting that the subscriber adjust their usage.
• Temporary suspension of the PRO account until the matter is resolved.
• Charging for or upgrading to a school licence at a special institutional rate.
• Cancellation of the subscription without refund in cases of severe or repeated violations.

4.5 School / Classroom Licensing

Teachers or institutions interested in classroom or school-wide access are invited to email info@spellingjoy.com for a customised quote.

5. Public Word Lists

Some word lists created by Parents may be displayed publicly to benefit the community. By creating and submitting word lists, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute these lists.

6. User Conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Share login credentials with unauthorized users.
• Post or submit any offensive, harmful, or misleading content.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

All content on the Site, including but not limited to software, design, text, and graphics, is owned by SpellingJoy.com or its licensors. Unauthorized use is prohibited.

8. Privacy

We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and safeguard your information.

9. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our Site or services. Our total liability is limited to the amount paid by you for the services.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be effective upon posting. Continued use of the Site constitutes acceptance of the revised Terms.
